Law on Criminal Records Article 2, Clause 4

A criminal record certificate is a certificate issued by the competent authority for issuing criminal record certificates that serves as proof of whether an individual has or has no conviction, and whether or not the individual is prohibited from holding positions or establishing, managing enterprises or cooperatives in cases where such enterprise or cooperative has been declared bankrupt by a court.

The criminal record certificate is required for your work permit application, which in turn is a prerequisite for a corporate Temporary Residence Card.

Unlike Vietnamese citizens, who can use VNeID, foreigners have to apply in person at the Criminal Records Department.1Law on Criminal RecordsArticle 44, Clause 1The Criminal Records Department of the Ministry of Public Security shall issue criminal record certificates in the following cases:a) Vietnamese citizens whose place of permanent residence or temporary residence cannot be determined;b) Foreigners who have resided in Vietnam.

The police department enforces a dress code. Men must wear long trousers, no shorts. Women must wear knee-length skirts or dresses, with midriff and cleavage covered.

Arrive on time. Sessions start promptly and fill up fast.

What to do

Register your application. From the entrance, walk into the courtyard. The registration office is in the building around the corner to your right. Take a seat and wait until an officer calls you. Hand over your documents. Make sure all originals (passport, TRC) are returned to you before you leave.

Pay and collect your receipt. You will be called to pay 200,000 VND in cash. Sign two receipts, matching your passport signature exactly. The officer signs one and returns it to you. Check that it has a red stamp. Keep it safe, you will need it to collect or track your certificate.

Optional: have the certificate delivered to you. You can arrange to have it couriered to your address instead of collecting it in person. Ask the officer when you submit your documents.

Processing time

Five working days in most cases.2Law on Criminal RecordsArticle 48, Clause 2The time limit for issuing a criminal record certificate is 05 working days from the date of receipt of a valid request; where there is conviction information or new criminal conduct requiring verification, the time limit may be extended but shall not exceed 15 days. For foreigners, the local police cross-check with the national criminal records database, which can extend the processing time. Allow up to 15 working days if you have any prior convictions to verify. The police department does not notify you when the certificate is ready, so follow up if you have not heard within four weeks.

The certificate is valid for six months from the date of issue.

Can I apply online?
No. Foreigners must apply in person or by postal service.3Law on Criminal RecordsArticle 45, Clause 1Individuals shall request criminal record certificates online.Foreigners and persons without a digital identity may request criminal record certificates in person or by postal service. Online applications through the Government Public Service Portal are only available to Vietnamese citizens.
How much does it cost?
200,000 VND for the certificate, payable in cash at the counter. The optional Viettel Post courier service costs an additional 20,000 VND.
Do I need to make an appointment?
No. Walk in during opening hours and join the foreigner queue. Arrive at the start of a session, as the queue fills up fast.
Can someone else apply or collect on my behalf?
Yes, in two ways. First, a parent, spouse, child, or legal guardian can apply for the certificate on your behalf without a separate authorisation.4Law on Criminal RecordsArticle 45, Clause 3An individual may request a criminal record certificate on behalf of their father, mother, spouse, child, or ward. Such requests shall be submitted in accordance with clause 2 of this Article. Second, you can authorise anyone else to either submit the application or collect the certificate for you. They will need a signed letter of authorisation and a copy of your passport.5Law on Criminal RecordsArticle 45, Clause 4An individual may authorize another person to complete the procedures for requesting a criminal record certificate. Such authorization must be made in writing in accordance with the law, and the request shall be submitted in accordance with points b and c of clause 2 of this Article.
What does the certificate show?
Your name, date of birth, nationality, and residence.6Law on Criminal RecordsArticle 42, Clause 1The full birth name, other names, sex, date of birth, place of birth registration, nationality, ethnicity, place of residence, and personal identification number or passport number in the absence of a personal identification number of the person to whom the certificate is issued. It then states either "no criminal record" or lists any active convictions with the offence, sentence, and enforcement status.7Law on Criminal RecordsArticle 42, Clause 2Conviction status:a) For persons with no conviction, it shall state “no conviction”. For persons convicted whose conviction does not yet satisfy the conditions for expungement, it shall state “convicted”, together with the charge, principal penalty, and supplementary penalty;b) For persons whose conviction has been expunged and whose expungement has been updated in the criminal record, it shall state “no conviction”;c) For persons granted general amnesty whose amnesty has been updated in the criminal record, it shall state “no conviction”. For work permit purposes, you need Certificate No. 1 (Phiếu lý lịch tư pháp số 1), which is what the police issue by default when you apply as an individual.
What languages is the certificate issued in?
Vietnamese only. If you need it for use abroad, you will need a certified translation.
What if I have never lived in Vietnam before?
If you have no residence history in Vietnam, the police department cannot issue a certificate. You will need a criminal record from your home country instead, which must be apostilled or consular-legalised and translated into Vietnamese.
How long is the certificate valid?
Six months from the date of issue.
